1. Introduction

Universal Capital Bank AD Podgorica recognises the importance of personal data protection and applies the regulations governing the protection of personal data.
Personal data includes any information relating to an identified or identifiable natural person.
Personal data processing includes any activity by which personal data are collected, recorded, registered, organised, stored, altered, retrieved, used, consulted, disclosed by transmission, published or otherwise made available, organised, combined, blocked, erased, destroyed, or any other activity which is taken with regard to personal data.
Identified or identifiable individual personal data encompasses any information relating to a natural person who is directly identified or can be identified, either directly or indirectly, by using one or more specific characteristics specific to the physical, physiological, mental, economic, cultural or social identity of that person.

4. When does the Bank process personal data

4.1. Execution and implementation of contracts

We process personal data for the purpose of providing financial services to clients and taking actions at the request of clients before signing a contract for the provision of financial services.
The Bank provides the following financial services: receives deposits and other funds from individuals and legal entities and approves loans and other placements from these funds, in whole or in part, for its own benefit; issues guarantees and assumes other obligations; purchases and collects receivables; issues, processes and records payment instruments (including credit cards, traveller’s and bank checks); domestic and international payment transactions; financial leasing; securities transactions; trades in its own name and for its own benefit or for the benefit of its clients: foreign means of payment, including exchange transactions; currency and interest rate instruments; data collection, analysis and provision of information and advice on the creditworthiness of companies and entrepreneurs and other business-related issues; deposit operations; safekeeping services; custody services.

4.2. Fulfilment of statutory obligations

The Bank processes personal data to fulfil statutory obligations (the Law on Credit Institutions, the Law on Payment Transactions, the Law on the Prevention of Money Laundering and Terrorist Financing, etc.). For example, the Bank is obliged to obtain a photocopy of the personal document in the Know Your Client process and enter the date, time, name and surname of the person who inspected the photocopy of the document, and to store that photocopy and the collected data in accordance with the Law on the Prevention of Money Laundering and Terrorist Financing.

4.3. Processing of personal data for the purpose of pursuing a regulatory interest

We process personal data for the purpose of pursuing a regulatory interest. The Bank processes personal data to carry out tasks related to its business activities. We process data, among other things, in the following cases:
-for measures to prevent, detect and investigate fraud and other harmful practices;
-for the purpose of ensuring the security of networks and information systems due to accidental events or illegal or malicious actions that threaten the availability, authenticity, integrity and confidentiality of stored or transmitted personal data and the security of related services offered or accessible through these networks and systems;
-for the development and management of the offer;
-for market research, business analysis and analysis with the aim of monitoring business decisions.

4.4. Processing of personal data with consent

The processing of personal data may be carried out with the prior consent of the person whose personal data is being processed. Consent is a voluntary statement by which the person, after being informed about the purpose of the processing, expresses their consent to the processing of their personal data for a specific purpose. Consent to the processing of personal data can be revoked at any time.
The Bank allows the processing of personal data for certain purposes based on consent, for example, for the implementation of marketing activities (informing about offers, benefits, events, prize games) or for surveys and questionnaires to check satisfaction with the aim of adjusting and improving its offer.

5. Collection of personal data

The Bank collects personal data from various sources. In most cases, they are directly forwarded by Clients. The Bank creates certain data when processing data for reporting, analysis, etc. Also, certain information is made available to the Bank from public sources (for example, public registers).The condition for any collection of personal data is the existence of an appropriate legal basis. The Bank collects and processes:

  1. Identification and contact details
    Name and surname, unique identification number, date of birth, residential address, identification document number, contact details, telephone number, e-mail address, etc.
  2. Data for creditworthiness assessment
    Data on the employer (including employment contract), data on earnings, other household income, data from the Credit Registry of the Central Bank of Montenegro, account number, etc. Property data (for certain types of services) - real estate and movable property owned by the Client.
  3. Sociodemographic data
    Age, gender, level of education, etc.
  4. Transaction data
    Our systems record every payment made from an account or payment card or via internet or mobile banking, as well as every cash withdrawal at an ATM, transactions we make on behalf of and at the request of a client, and any payment made to a client's account. Each transaction also contains additional information, for example, the transaction amount, the payment account number, the name and number of the merchant's POS terminal through which the payment was made, the merchant's address or location, and the date and time of payment.
  5. Related party data
    Relationship based on control or joint action or based on kinship as well as other types of relationships in accordance with applicable regulations.
  6. Survey, research and testing data
    Data about clients, potential clients and other individuals from surveys, research and testing (for example, clients' opinions on existing services and advertisements).
  7. Data collected and processed in accordance with regulations
    These are data that the Bank must collect, evaluate and store for a certain period of time to comply with the regulations. For example, the obligation to archive data in accordance with laws governing business activities, or the collection and evaluation of data with the aim of preventing money laundering and terrorist financing. Such data may include: resources and sources of income, mutual capital ties, citizenship, residential address, area of ​​activity, political exposure and the like.
  8. Data on the use of financial services
    Data on the use of financial services, which services are used, under what terms, whether they have been retained or cancelled, the frequency of use of the payment card and the locations where it is used, the amount and purpose of the transaction. If the Client has been granted a loan, data on the amount and date of a certain instalment or on late payment and the like.
  9. Other personal data
    The Bank collects and processes other personal data that are not explicitly listed herein, and in accordance with the law and the principles and standards contained in ratified international treaties and generally accepted rules of international law.

6. Storage and access to personal data

The Bank complies with the obligation to store personal data in its operations.The Bank provides technical, personnel and organisational measures to protect personal data, to protect such data against loss, destruction, unauthorised access, change, disclosure, as well as misuse. Members of the Bank's bodies, shareholders, employees, external auditors and other persons who, due to the nature of the work they perform with the Bank or for the Bank, have access to personal data, are obliged to store personal data and may not make them available to third parties, use them against the interests of the Bank and its Clients, or enable third parties to use them.Personal data relating to data on individual deposit balance, account balance and transactions on individual accounts, loan beneficiaries and the balance of their loans, as well as other data and information about the Client obtained by the Bank based on the provision of financial services and in performing transactions with the Client, may be made available to the Central Bank of Montenegro, the competent court or other authorities, in accordance with the law.

7. Processing of personal data

The Bank processed data either manually or automatically (automated data processing).Automated data processing is carried out in accordance with the law, for the purpose of fulfilling contractual obligations, with the explicit consent of the person whose data is being processed or in accordance with the legitimate interests of the Bank. The Bank enables individuals to exercise the right to object to automated data processing. The objection may be submitted to either the initial or further processing of personal data, at any time.

8. Right to submit requests and complaints

Upon the written request of an individual, no later than 15 days from the date of submission of the request, the Bank is obliged to provide notification of whether personal data relating to that individual is being processed. If personal data is being processed, the written notification shall contain information on: the name and address of the Bank; the content of the data being processed; the purpose and legal basis for the processing of personal data; the source of the data according to available information; the third party, i.e. the user; and the method of automated data processing.Upon written request of the person whose personal data is being processed, within 15 days from the date of submission of the request, the Bank is obliged to: supplement incomplete or amend, or delete inaccurate personal data; delete personal data, if its processing is not in accordance with the law. The Bank shall notify the person to whom the personal data relate of the completed supplement, amendment and deletion of personal data within eight days. Should the Bank fail to act in the described manner or reject the request, the person has the right to file a complaint with the Bank or to request protection of rights with the Agency for Personal Data Protection and Free Access to Information.
The complaint shall be submitted in writing to the address: Universal Capital Bank AD Podgorica, Ulica Stanka Dragojevića bb, 81000 Podgorica (with the indication: Attn: Compliance Officer) or to the e-mail: prigovori@ucbank.me.
The complaint shall contain: name and surname, address and telephone number; description of the disputed event/situation/circumstances; appropriate documentation (if applicable). The Bank is obliged to respond to the complainant within a reasonable time, and no later than eight days from the date of receipt of the complaint.
A person who believes that their rights prescribed by the Law on Personal Data Protection have been violated may submit a request for protection of rights to the Agency for Personal Data Protection and Free Access to Information.

1. Browsing the website (www.ucbank.me) is anonymous and no data such as name and surname, address, telephone number or e-mail is collected.

2. The Bank automatically collects data about the device the Clients use to access the website. This data may include their IP address, browser type, domain name, access time and website address. The Bank uses this data for the purpose of offering its services, maintaining its quality and obtaining general statistical data related to the use of the website.
